캐나다는 세계에서 가장 LGBTQ+ 친화적인 국가 중 하나입니다. 당신의 권리를 발견하고, 커뮤니티 조직을 찾고, 성적 지향에 기반한 난민 신청에 대해 알아보세요.

Canada is widely recognized as one of the most LGBTQ+-inclusive countries in the world. As an LGBTQ+ newcomer, you are arriving in a country where your rights are protected by law, same-sex marriage is legal since 2005, and discrimination based on sexual orientation and gender identity is prohibited.

LGBTQ+ Rights in Canada

  • Same-sex marriage: Legal across Canada since 2005 (Civil Marriage Act)
  • Canadian Human Rights Act: Prohibits discrimination based on sexual orientation (1996) and gender identity/expression (2017)
  • Conversion therapy: Illegal in Canada
  • Gender markers: Change to M, F, or X on passports and most provincial documents without surgery
  • Hate crimes based on sexual orientation and gender identity are criminally prohibited

LGBTQ+ Refugee Claims

If you faced persecution due to your sexual orientation or gender identity, you may claim refugee status. Claims can be based on criminalization of same-sex conduct, violent discrimination, forced marriage, or other persecution. The fear of persecution is sufficient — you don't need to have been physically harmed. Contact Rainbow Refugee Canada for specialized legal support.

Community Organizations

  • PFLAG Canada: Support for LGBTQ+ individuals and families (pflagcanada.ca)
  • Egale Canada Human Rights Trust: National LGBTQ+ rights advocacy

Healthcare for LGBTQ+ Newcomers

Sherbourne Health (Toronto), GLAD Health (Vancouver), and community health centres across Canada provide LGBTQ+-affirming care. Gender-affirming care including hormone therapy is covered by provincial insurance. HIV/AIDS testing and treatment are free at sexual health clinics.

Document Updates for Trans and Non-Binary Newcomers

  • Passport: Apply through IRCC — choose M, F, or X
  • SIN records: Submit Request to Amend Information to Service Canada
  • Most provinces allow gender marker changes without surgery

Anti-Discrimination Resources

File complaints with the Canadian Human Rights Commission (federal) or your provincial human rights tribunal (employment, housing, services). Contact LGBTQ+ legal clinics for free advice.
